Your obligations — what MyAiCompany does, and what stays with you
General information for a business based in Switzerland, checked on 29 September 2026 against official sources.

What MyAiCompany does
MyAiCompany gives you the tools of a company: website, shop, domain in your name, mail, invoices, agents. It does not incorporate your company and registers nothing on your behalf. What it does on top:
- it counts your paid invoices over twelve months and warns you at 80 %, then at 100 % of the VAT and commercial register thresholds (Town Hall → Account → Obligations);
- it refuses to issue an invoice with VAT until you have declared your registration and number;
- on request, it puts you in touch with an accountant, a business address provider or a partner to incorporate your company. The partner advises and bills you directly; any referral fee received by Ninabot is disclosed beforehand.
The counter only sees what goes through MyAiCompany. If you collect money elsewhere, the total is what counts.
Choosing a legal form
- Sole proprietorship: you trade in your own name, no minimum capital, and you are liable with all your assets. It is the default as soon as you sell.
- GmbH/Sàrl (capital CHF 20,000) or AG/SA (capital CHF 100,000): a separate legal entity, set up before a notary. It only exists once entered in the commercial register.
Commercial register
- A sole proprietorship must register from CHF 100,000 of revenue per year. Below that, it is optional.
- A GmbH or AG is always registered: registration is what creates it.
- Online: EasyGov, with your canton's register.
VAT
- Registration with the Federal Tax Administration becomes mandatory from **CHF 100,000 of worldwide turnover per year**, all activities together. Below that, it is optional.
- An invoice may only carry VAT if you are registered: VAT invoiced without registration is owed anyway.

AHV/AVS and social insurance
- From your first self-employed income, register with your canton's AHV/AVS compensation fund: it is the fund that recognises your self-employed status. It is the most often forgotten duty, and it comes well before VAT.
- If your company pays you a salary, or you hire someone, it registers as an employer (AHV/AVS, accident insurance, occupational pension depending on the salary).

Trade permits
Some activities need a permit before selling: food, alcohol, health, finance, transport, security, among others. Ask your canton; the federal SME portal is a good starting point.
Your online shop
- Legal notice: your name (or company name), your address and a contact e-mail address must appear on the site (Unfair Competition Act).
- Prices: shown in Swiss francs, taxes included.
- Terms of sale and data protection (FADP): you are their author and answer for them, even when an agent helps you write them.
Outside Switzerland
If you are based outside Switzerland, your duties depend on your country, and MyAiCompany cannot inform you about them. You alone remain responsible (Terms § 11.4). Talk to a professional in your country.
